POSTION: Special Defender - $25,200 Annually (part-time contract position) (No benefits included)
The Third Judicial Circuit Court is accepting applications for the position of Special Defender. This part-time contract position will be working predominantly with criminal court proceedings.
GENERAL STATEMENT OF DUTIES: The Special Defender is a legal representative to an indigent party in a criminal or juvenile court proceeding as specifically appointed by the Court for a particular individual in a particular case. The appointment is made after a determination by the Court that the party is indigent and that the Madison County Public Defender is unable to represent the party due to a potential conflict of interest or a conflict caused by its current representation. These appointments are made as necessary by the Court, but the assignments will be distributed among several attorneys. Generally, this particular special defender position will be assigned primarily to pending felony cases consisting of all classes of felonies. This position will require representation of defendants in all aspects of criminal litigation including preliminary hearings, pretrial motions, disposition by plea or trial and sentencing. Generally, this position would not require representation on post-conviction matters.
EXAMPLES OF DUTIES AND RESPONSIBILITIES
Special defenders are expected to demonstrate the same level of zealous representation and ethical constraints as they would in representing a private client.
Maintain communication with clients, including in-person visits, phone conferences, letters, and/or visits to correctional facilities.
Independently research applicable law and file motions and pleadings.
Negotiate plea agreements with the State’s Attorney’s Office
Special Defenders must maintain a malpractice insurance policy at all times. A copy of which must be filed in the Office of the Chief Judge.
SUPERVISION RECEIVED:
Supervision is provided by the Chief Judge and an assigned judge.
MINIMUM QUALIFICATIONS
Applicants must have a J.D. degree from an accredited law school and have passed the Illinois State Bar exam.
SUMMARY
The list of duties above is meant to give a basic description of the duties and responsibilities of the Special Defender. The Special Defender is employed at the discretion of the Chief Judge.
